N.H. Rev. Stat. Ann. § 205-A: § 205-A:23
Exceptions.
Operative Text
Notwithstanding the provisions of RSA 205-A:21, the owner of a manufactured housing park shall not be required to give notice to the tenants if: I. A bank, mortgage company, or any other mortgagee has foreclosed on the park and said mortgagee: (a) Is selling the park at a foreclosure sale; or (b) Is selling the park after having purchased the park at a foreclosure sale. II. The sale or transfer is to a family member of the owner or to a trust, the beneficiaries of which are family members of the owner. III. The sale or transfer is by a partnership to one or more of its partners. IV. The conveyance of an interest in the park is incidental to the financing of such park. V. The sale or transfer is between joint tenants or tenants in common. VI. The sale is pursuant to eminent domain.
New Hampshire law under N.H. Rev. Stat. Ann. § 205-A:23 carves out specific situations in which the owner of a manufactured housing park is not required to give tenants advance notice before a sale or transfer of the park. These exceptions cover scenarios such as foreclosure sales by a mortgagee, transfers to family members or family trusts, partnership transfers to partners, financing-related conveyances, transfers between co-owners, and sales through eminent domain. Outside of these defined exceptions, the general notice requirement under RSA 205-A:21 continues to apply.

Under § 205-A:23, manufactured housing park owners and mortgagees operating within one of the listed exception categories are generally not obligated to provide the tenant-notice otherwise required by RSA 205-A:21. Compliant operators typically document the nature of the transaction carefully — for example, confirming that a transfer is genuinely to a qualifying family member, between partners, or arises from a foreclosure — so that the basis for the exception is clear in the transaction record. Operators should be aware that transactions falling outside these enumerated categories remain subject to the full notice requirements of RSA 205-A:21.

N.H. Rev. Stat. Ann. § 205-A:23 identifies a limited set of circumstances in which park owners are relieved of the obligation to notify tenants before a sale or transfer of the park. If a sale occurs without notice and tenants believe the transaction does not fit one of the listed exceptions — such as a foreclosure sale, a family transfer, or an eminent domain proceeding — they may have grounds to raise a violation of RSA 205-A:21's notice requirement. Tenants in this situation may wish to consult a tenant-rights organization or legal aid provider familiar with New Hampshire manufactured housing law to understand what options may be available.
