N.H. Rev. Stat. Ann. § 205-A: § 205-A:13-a
Any violation of the provisions of RSA 205-A:2 shall also constitute an unfair trade practice within the meaning of RSA 358-A and may be enforced as provided in RSA 358-A.

Plain English

Under N.H. Rev. Stat. Ann. § 205-A:13-a, any breach of the manufactured housing park obligations set out in RSA 205-A:2 is treated not only as a violation of the manufactured housing statute but also as an unfair trade practice under New Hampshire's Consumer Protection Act (RSA 358-A). This dual classification means the conduct can be pursued through the enforcement mechanisms available under that broader consumer-protection law, which may include civil remedies beyond those found in the housing statute alone.

For Property Managers

Operators of manufactured housing parks should be aware that § 205-A:13-a extends the consequences of non-compliance with RSA 205-A:2 into consumer-protection territory. A compliant park operator generally ensures that all practices governed by RSA 205-A:2—such as proper notice, lease terms, and park rules—are followed consistently, because a misstep can trigger unfair-trade-practice liability under RSA 358-A in addition to any housing-specific penalties. Operators familiar with both statutes are better positioned to maintain practices that satisfy the requirements of each.

For Tenants

Section 205-A:13-a gives residents of manufactured housing parks an additional legal avenue when a park owner violates RSA 205-A:2: the same conduct may be pursued as an unfair trade practice under RSA 358-A, New Hampshire's Consumer Protection Act. RSA 358-A provides its own set of remedies, which can include damages and attorney's fees, and complaints may be directed to the New Hampshire Attorney General's Consumer Protection Bureau. Tenants who believe a violation has occurred may also wish to consult a tenant-rights organization or legal aid provider to understand which enforcement paths are available to them.
