Neb. Rev. Stat. § 76-1450 et seq. § 76-1492
Landlord; duties; powers.
Operative Text
(1) A landlord shall: (a) Make all repairs and do whatever is necessary to put and keep the mobile home park in a fit and habitable condition; (b) Keep all common areas of the mobile home park in a clean and safe condition; (c) Maintain in good and safe working order and condition all facilities supplied or required to be supplied by the landlord; (d) Provide for the removal of garbage, rubbish, and other waste from the mobile home park; and (e) Furnish outlets for provided utilities. (2) A landlord shall not impose any condition connected with the rental or occupancy of a mobile home space which requires the tenant's exclusive use of a seller of fuel, furnishings, goods, services, or mobile homes unless such condition is necessary to protect the health, safety, aesthetic value, or welfare of mobile home tenants in the park. A landlord may impose reasonable requirements designed to standardize methods of utility connection and hookup. If any such conditions are imposed which result in charges for the goods or services, the charges shall not exceed the actual cost incurred in providing the tenant with the goods or services.
Under Neb. Rev. Stat. § 76-1450 et seq. § 76-1492, Nebraska law sets out a baseline of conditions that mobile home park landlords must maintain. The park itself, its common areas, and all landlord-supplied facilities must be kept fit, habitable, clean, and in safe working order, and the landlord must arrange for waste removal and utility outlets. The provision also limits a landlord's ability to require tenants to use a specific vendor for fuel, goods, or services, and where any such requirement is permitted, the charges imposed cannot exceed the landlord's actual cost.

Operators of mobile home parks in Nebraska should be familiar with the affirmative maintenance duties spelled out in Neb. Rev. Stat. § 76-1450 et seq. § 76-1492, which cover everything from habitability repairs to garbage removal and utility hookups. Compliant operators generally keep documentation of routine inspections, maintenance work, and waste-removal arrangements for all common areas and landlord-supplied facilities. When standardizing utility connection methods or working with preferred vendors, operators typically ensure that any charges passed to tenants reflect only the actual cost of providing those goods or services, as the statute requires.

Neb. Rev. Stat. § 76-1450 et seq. § 76-1492 establishes rights for mobile home park tenants, including the right to a habitable space, clean and safe common areas, properly functioning landlord-supplied facilities, and waste removal services. The provision also protects tenants from being forced to use a single vendor for fuel, furnishings, or other goods and services unless a narrow health, safety, or welfare justification applies—and even then, charges cannot exceed the landlord's actual cost. Tenants who believe these standards are not being met may consider documenting conditions, contacting a local tenant-rights organization, or exploring remedies available under Nebraska's mobile home landlord-tenant statutes.
