Neb. Rev. Stat. § 76-1450 et seq. § 76-1488
Landlord's successor in interest; rights and obligations.
Operative Text
Upon the termination of a landlord's interest in a mobile home park and compliance with section 76-1487 , the landlord shall be relieved of any further liability with respect to the rental deposit. The landlord's successor in interest shall have all the rights and obligations of the landlord with respect to the rental deposits, except that if the tenant does not object to the amount stated in the notice required by subdivision (1) of section 76-1487 within twenty days after receipt of the notice, the obligations of the landlord's successor to return the deposit shall be limited to the amount contained in the notice.
Under Neb. Rev. Stat. § 76-1450 et seq. § 76-1488, when a mobile home park changes ownership, the outgoing landlord is released from deposit-related liability once the notice requirements of § 76-1487 are satisfied. The incoming owner steps into the prior landlord's shoes, inheriting both the rights and the obligations tied to tenants' rental deposits. However, if a tenant does not dispute the deposit amount stated in the required notice within twenty days of receiving it, the new owner's obligation to return the deposit is capped at the figure listed in that notice.

Operators acquiring a mobile home park should be aware that, under Neb. Rev. Stat. § 76-1450 et seq. § 76-1488, they automatically assume all deposit-related rights and obligations from the prior owner. Compliant incoming owners typically ensure they have received accurate deposit records and that the § 76-1487 notice was properly delivered to each tenant. When the notice process is followed correctly, the successor's maximum deposit-return obligation for any non-objecting tenant is limited to the amount stated in that notice.

Neb. Rev. Stat. § 76-1450 et seq. § 76-1488 protects mobile home park tenants by ensuring that a change in park ownership does not eliminate the new owner's responsibility to return rental deposits. Tenants who believe the deposit amount listed in the § 76-1487 notice is incorrect have twenty days from receipt of that notice to raise an objection; failing to do so may limit what the new owner is required to return. Tenants with questions about this process may consider contacting a local tenant-rights organization or consulting the Nebraska statutes directly to understand available options.
