Operative Text
(1) The Affordable Housing Trust Fund is created. The fund shall receive money pursuant to section 76-903 and may include appropriations from the Legislature, transfers authorized by the Legislature, grants, private contributions, repayment of loans, and funds from all other sources. The Department of Economic Development as part of its comprehensive housing affordability strategy shall administer the Affordable Housing Trust Fund. (2)(a) Prior to July 1, 2027, transfers may be made from the Affordable Housing Trust Fund to the General Fund, the Behavioral Health Services Fund, the Middle Income Workforce Housing Investment Fund, the Rural Workforce Housing Investment Fund, and the Site and Building Development Fund at the direction of the Legislature. (b) Beginning on and after July 1, 2027, money shall not be transferred from the Affordable Housing Trust Fund.
Neb. Rev. Stat. § 58-701 et seq. § 58-703 establishes Nebraska's Affordable Housing Trust Fund as a dedicated public fund administered by the Department of Economic Development under its comprehensive housing affordability strategy. The fund draws from a variety of sources, including legislative appropriations, grants, private contributions, and loan repayments. Before July 1, 2027, the Legislature may direct transfers out of the fund to several other state funds, but starting on that date, no such transfers are permitted, locking the money in place for affordable housing purposes.

Neb. Rev. Stat. § 58-701 et seq. § 58-703 creates a state-level Affordable Housing Trust Fund intended to support housing affordability efforts across Nebraska, which can translate into expanded access to affordable rental units and housing assistance programs. Tenants who believe they may qualify for housing assistance funded through this mechanism can inquire with the Nebraska Department of Economic Development or local tenant-rights organizations about available programs. After July 1, 2027, the fund's protections against transfers mean resources are more firmly dedicated to affordable housing, which tenants may find relevant when evaluating the long-term availability of subsidized housing options in their area.
