Neb. Rev. Stat. § 20-301 et seq. § 20-167
Discrimination; legislative intent; state agencies; duties.
Operative Text
It is the intent of the Legislature that no person should be discriminated against on the basis of having taken a human immunodeficiency virus antibody or antigen test. Each agency of state government shall examine policies and practices within its jurisdiction that may intentionally or unintentionally result in discrimination against a person who has taken a human immunodeficiency virus antibody or antigen test or who has been diagnosed as having acquired immunodeficiency syndrome or acquired immunodeficiency syndrome related complex to ascertain the extent and types of discrimination that may exist. Each agency shall identify proposed changes in statutes or agency rules and regulations to remedy discrimination. Each agency shall report its findings to the Legislature on or before December 1, 1988.
Neb. Rev. Stat. § 20-301 et seq. § 20-167 expresses the Nebraska Legislature's intent that no person should face discrimination because they have taken an HIV antibody or antigen test or have been diagnosed with AIDS or AIDS-related complex. The provision directed every state government agency to review its own policies and practices for potential discriminatory effects, propose remedial changes to statutes or regulations, and report findings to the Legislature by December 1, 1988. This provision establishes a foundational anti-discrimination principle and a government self-examination mandate, rather than creating a private enforcement mechanism on its own.

Property owners and managers operating in Nebraska should be aware that Neb. Rev. Stat. § 20-301 et seq. § 20-167 reflects a clear legislative policy against discrimination based on HIV testing or AIDS diagnosis. Compliant operators generally ensure that rental policies, application screening criteria, and tenant communications do not treat individuals differently on the basis of HIV-related status. Reviewing internal policies against this stated legislative intent is a practice consistent with operating in good faith under Nebraska's broader anti-discrimination framework.

Neb. Rev. Stat. § 20-301 et seq. § 20-167 signals Nebraska's legislative commitment to protecting individuals from discrimination tied to HIV testing or an AIDS-related diagnosis, including in housing contexts. Tenants who believe they have experienced such discrimination may consider documenting the conduct, contacting a tenant-rights organization, or exploring complaint processes available through relevant state agencies. Because this provision directed state agencies to identify and remedy discriminatory practices, those agencies may be a resource for understanding what protections and reporting channels are available.
