Neb. Rev. Stat. § 20-301 et seq. § 20-131.02
Housing accommodations; terms, defined.
Operative Text
For purposes of sections 20-131.01 to 20-131.04 , unless the context otherwise requires: (1) Housing accommodations means any real property which is used or occupied or is intended, arranged, or designed to be used or occupied as the home, residence, or sleeping place of one or more human beings. Housing accommodations does not include any single-family residence in which the owner lives and in which any room is rented, leased, or provided for compensation to persons other than the owner or primary tenant; and (2) Disability has the same meaning as in 42 U.S.C. 12102, as such section existed on January 1, 2021.
Nebraska Revised Statute § 20-131.02 establishes the definitions that apply throughout the state's fair housing provisions found in sections 20-131.01 to 20-131.04. Under this provision, 'housing accommodations' broadly covers real property used, intended, or designed as a home, residence, or sleeping place, but explicitly excludes owner-occupied single-family homes where the owner rents out a room. The term 'disability' is defined by reference to the federal Americans with Disabilities Act definition as it stood on January 1, 2021.
Plain English — not legal advice.
Property owners and managers operating under Nebraska's fair housing framework should understand that § 20-131.02 determines whether their property falls within the scope of sections 20-131.01 to 20-131.04. Operators of multi-unit buildings, rental homes, and similar residential properties are generally covered by the 'housing accommodations' definition, meaning the anti-discrimination obligations in those sections apply to their operations. The narrow exemption for owner-occupied single-family homes where the owner personally rents a room is limited in scope, and operators who do not meet that specific description should treat their properties as covered accommodations.

Nebraska Revised Statute § 20-131.02 sets out the foundational definitions that determine who is protected under the state's housing anti-discrimination rules in sections 20-131.01 to 20-131.04. Tenants living in most rental housing—including apartments, rental houses, and other residential properties—are generally covered by these definitions, which include a disability standard tied to federal law. Tenants who believe a landlord has improperly claimed an exemption or violated protections tied to these definitions may consider contacting a local tenant-rights organization or a fair housing agency for general information about available complaint processes.
