Cal. Civ. Code § 70-33-313
Lot Rules
Operative Text
(1) A landlord may adopt a rule concerning the rental occupancy of a lot and the use of common areas and facilities in accordance with 70-33-311 . A rule may not be unreasonable, and a rule that does not apply uniformly to all tenants of a similar class creates a rebuttable presumption, as defined in 70-33-431 (3), that the rule is unfair. (2) Each common area facility must be open or available to residents at all reasonable hours, and the hours of a common recreational facility must be posted at the facility.
Under Mont. Code Ann. § 70-33-313, landlords in Montana mobile home lot rentals are permitted to establish rules governing how lots are occupied and how shared spaces and facilities are used, provided those rules are reasonable. Any rule that is not applied uniformly to all tenants in a similar class carries a rebuttable presumption of being unfair. Additionally, common area facilities must be accessible during all reasonable hours, and the hours of any shared recreational facility must be visibly posted at that location.
Plain English — not legal advice.
Operators subject to Mont. Code Ann. § 70-33-313 generally adopt lot and common-area rules that are reasonable in scope and apply them consistently across all tenants who fall within a similar class, since selective enforcement creates a rebuttable presumption of unfairness. Compliant operators also ensure that every common area facility remains open or available during reasonable hours and that the operating hours of any shared recreational facility are clearly posted at the facility itself. Keeping written records of how rules are communicated and applied uniformly can support a showing of consistent, non-discriminatory management.

Mont. Code Ann. § 70-33-313 gives tenants the right to expect that any lot or common-area rule imposed by a landlord is reasonable and applied equally to all tenants in a similar situation. If a rule appears to single out certain tenants, the law establishes a rebuttable presumption that the rule is unfair, which tenants may be able to raise as a defense in a dispute. Tenants who believe a rule is being applied unequally, or that common facilities are being improperly restricted, may consider contacting a local tenant-rights organization or consulting with a housing attorney familiar with Montana's mobile home lot rental statutes.
