Cal. Civ. Code § 70-33-102
Purpose -- Liberal Construction
Operative Text
(1) This chapter must be liberally construed and applied to promote the underlying purposes and policies of this chapter. (2) The underlying purposes and policies of this chapter are to: (a) simplify and clarify the law governing the rental of land to owners of mobile homes and manufactured homes and the rights and obligations of landlords and tenants concerning lot rentals; (b) encourage landlords and tenants to maintain and improve the quality of housing; and (c) create an exclusive regulatory standard throughout the state and its political subdivisions regarding the rental of land to owners of mobile homes and manufactured homes.
Montana Code Ann. § 70-33-102 establishes the foundational purposes of the state's mobile home and manufactured home lot rental law. The chapter is designed to be interpreted broadly and favorably to advance its goals: clarifying the rights and duties of landlords and tenants in lot rental arrangements, encouraging upkeep and improvement of housing quality, and creating a uniform statewide standard that supersedes local regulations on this subject. Courts and agencies applying this chapter are directed to read its provisions in the light most favorable to achieving these objectives.
Plain English — not legal advice.
Property owners and managers who rent lots to mobile home or manufactured home owners operate under a statewide framework established by Mont. Code Ann. § 70-33-102, which preempts local ordinances on this subject. Because the chapter is to be liberally construed, compliant operators generally familiarize themselves with the full scope of rights and obligations it sets out, rather than relying solely on local rules or informal custom. Maintaining and improving lot and housing quality is explicitly named as a policy goal of this chapter, so operators who document upkeep efforts align their practices with the statute's stated purposes.

Mont. Code Ann. § 70-33-102 signals that the protections and rights found throughout this chapter are meant to be read broadly in favor of the law's underlying goals, which include clarifying tenant rights in lot rental situations and encouraging housing quality. Tenants in mobile home or manufactured home lot arrangements can look to this chapter as the exclusive statewide standard governing their rental relationship, meaning local rules generally cannot reduce the protections the chapter provides. Tenants who believe their rights under this chapter have been violated may consider consulting a tenant-rights organization or legal aid provider familiar with Montana's mobile home lot rental law for guidance on available remedies.
