Cal. Civ. Code § 37.111.334
37.111.334 FLOORS, WALLS, CEILINGS AND LIGHTING
Operative Text
(1) The floors, walls and ceilings and attached equipment in food preparation and service areas and in employee bath rooms of bed and breakfast establishments must be fabricated from easily cleanable material and must be maintained in good repair and kept clean. Artificial lighting must be provided sufficient to facilitate sanitary food handling and cleaning of facilities. Light sources in food preparation areas must be adequately shielded or be made of a shatter resistant design or material. (2) Carpeting, if used as a floor covering in food preparation areas or in toilet facilities, must be of closely woven construction. All carpeting located in guest rooms, hallways and other portions of the bed and breakfast used by guests must be properly installed, easily cleanable and maintained in good repair.
Mont. Admin. R. 37.111.334 sets physical standards for floors, walls, ceilings, and lighting in bed and breakfast establishments, covering both food-service areas and guest spaces. Surfaces in food preparation and employee bathrooms must be made of easily cleanable materials, kept in good repair, and kept clean, while adequate artificial lighting and shielded or shatter-resistant light sources are required in food prep areas. Carpeting is permitted but must meet specific construction and maintenance standards depending on where it is installed.
Plain English — not legal advice.
Operators of bed and breakfast establishments subject to Mont. Admin. R. 37.111.334 generally maintain all food preparation and employee bathroom surfaces in cleanable condition and good repair, and ensure lighting in food prep areas is sufficient and that light fixtures are shielded or shatter-resistant. Where carpeting is used in food preparation areas or toilet facilities, compliant operators select closely woven carpet and keep it clean and in good repair; carpeting in guest rooms and hallways must be properly installed and maintained. Routine inspection of these surfaces and fixtures helps demonstrate ongoing compliance with the rule.

While Mont. Admin. R. 37.111.334 primarily governs bed and breakfast operators, guests who observe deteriorating surfaces, inadequate lighting, or poorly maintained flooring may have grounds to raise concerns with the relevant state or local health authority responsible for inspecting lodging establishments. Montana's Department of Public Health and Human Services oversees licensing and inspection of bed and breakfast facilities, and complaints about conditions covered by this provision can generally be directed there. Tenant-rights organizations or consumer protection resources may be able to help individuals understand what remedies or reporting options are available.
