Cal. Civ. Code § 37.111.330
37.111.330 SOLID WASTE AND PEST CONTROL
Operative Text
(1) Garbage and refuse must be kept in durable, easily cleanable, insect proof and rodent proof containers that do not leak and do not absorb liquids. Plastic bags and wet strength paper bags may be used to line these containers and they may be used for storage inside the establishment. The containers must be kept clean and in good repair and be of sufficient number to hold the solid waste that accumulates. (2) Outside storage of unprotected plastic bags or wet strength paper bags or baled units containing garbage or refuse is prohibited. Cardboard or other packaging material not containing garbage or food wastes need not be stored in covered containers. (3) Garbage and refuse must be disposed of often enough to prevent the development of odor and the attraction of insects and rodents. (4) Effective measures intended to minimize the presence of rodents, flies, cockroaches and other insects on the premises must be utilized.
Mont. Admin. R. 37.111.330 establishes standards for how solid waste must be stored and managed at regulated establishments in Montana. Garbage and refuse must be kept in durable, leak-proof, pest-resistant containers that are maintained in good condition and sufficient in number, and waste must be disposed of frequently enough to prevent odors and pest attraction. Unprotected plastic or paper bags left outside are prohibited, and operators must actively take measures to minimize the presence of rodents, flies, cockroaches, and other insects on the premises.
Plain English — not legal advice.
Under Mont. Admin. R. 37.111.330, compliant operators generally maintain an adequate supply of durable, cleanable, insect- and rodent-proof waste containers in good repair, and ensure garbage is removed on a schedule that prevents odor buildup and pest attraction. Outside storage of unprotected bags containing garbage or refuse is not permitted, so operators typically use covered, sealed containers for any exterior waste storage. Ongoing pest control measures — such as routine inspections, exclusion methods, and treatment protocols — are a standard part of maintaining compliance with this provision.

Mont. Admin. R. 37.111.330 sets baseline requirements for waste storage and pest control at regulated establishments, which can directly affect the habitability and sanitation of a rental property. If garbage containers are inadequate, waste is improperly stored outside, or pest infestations go unaddressed, these conditions may constitute a violation of this provision. Tenants who observe such conditions can document them, report concerns to the relevant local or state health authority in Montana, or reach out to a tenant-rights organization to understand what options may be available.
