Plain English

Missouri Revised Statutes § 534.230 establishes the scope of a lawful possessor's claim when someone else has forcibly entered or unlawfully detained their land. Under this provision, the person with lawful possession is recognized as entitled to the full extent of land they can legally claim under their title documents—such as a patent, deed, survey, or similar instrument—as defined by federal or state law. The rule ensures that a wrongdoer cannot limit or chip away at the lawful possessor's recognized boundaries simply by occupying part of the property.

For Property Managers

Property owners and managers operating under Missouri Revised Statutes § 534.230 should understand that their enforceable claim in a forcible entry and detainer action extends to the full boundaries established by their title documents, including deeds, surveys, grants, or other recognized instruments. Compliant operators typically maintain clear, organized records of all title and survey documentation so that the full extent of their lawful claim can be readily demonstrated in any legal proceeding. Keeping these records current and accessible is a common practice among property managers who may need to assert the full scope of their possessory rights.

For Tenants

Missouri Revised Statutes § 534.230 can be relevant to tenants or other lawful possessors who face a forcible entry or unlawful detainer situation, as it affirms that the person with lawful possession is entitled to the full extent of land recognized under their legal claim. If someone has wrongfully entered or withheld possession of property, this provision supports the lawful possessor's right to assert the complete boundaries of that claim—not just a portion. Tenants or possessors facing such a situation may find it useful to gather any relevant title, lease, or survey documents and to consult a tenant-rights organization or legal aid service familiar with Missouri landlord-tenant law.
