Cal. Civ. Code § 441.630
Duties of occupant
Operative Text
Every occupant of a dwelling unit under the provisions of sections 441.500 to 441.643 shall be responsible to pay all rents due from him or her when such rents become due and to exercise reasonable care: (1) To dispose of all rubbish and garbage in his or her dwelling unit, and other organic waste which might provide food for rodents, in a clean and sanitary manner; (2) To refrain from unreasonable use of electrical, heating, and plumbing fixtures; (3) To meet all obligations lawfully imposed upon the occupants of dwelling units by the code enforcement agency or the community; (4) To refrain from willfully or wantonly destroying, defacing, damaging, impairing or removing any part of the structure or dwelling unit or the facilities, equipment, or appurtenances thereof, and to prohibit any other person on the premises with his or her permission from doing likewise; and (5) Shall not under any circumstances take in additional occupants, sublease, rent or turn over said premises to any persons without the owner's knowledge and consent.
Missouri Revised Statutes § 441.630 sets out a list of baseline responsibilities that apply to every occupant of a covered dwelling unit. These duties include paying rent on time, keeping the unit clean and free of waste that could attract pests, using utilities and fixtures reasonably, complying with local code requirements, and avoiding damage to the property. The provision also prohibits occupants from adding new residents, subleasing, or otherwise transferring the premises to anyone else without the owner's knowledge and explicit consent.

Under Mo. Rev. Stat. § 441.630, compliant property operators typically document the occupant duties outlined in this statute within their lease agreements so that expectations are clear from the start of tenancy. Operators generally conduct periodic inspections—where permitted by law and lease—to verify that units are being maintained in a sanitary condition and that fixtures are not being misused. Because § 441.630 expressly prohibits unauthorized subletting or additional occupants, operators commonly include lease provisions that mirror this requirement and establish procedures for reviewing and approving any requested changes to occupancy.

Mo. Rev. Stat. § 441.630 defines the affirmative duties that Missouri law places on occupants of covered dwelling units, including timely rent payment, sanitary waste disposal, reasonable use of utilities, and compliance with local housing codes. Tenants should be aware that the statute explicitly prohibits bringing in additional occupants or subleasing without the owner's knowledge and consent, meaning a landlord may have grounds to raise a lease violation based on this provision. Tenants who have questions about how § 441.630 applies to their situation, or who believe a landlord is misapplying it, may wish to contact a local tenant-rights organization or a Missouri legal aid office for general information.
