Cal. Civ. Code § 441.005
Definitions
Operative Text
Except as otherwise provided, when used in chapter 534, chapter 535, or this chapter, the following terms mean: (1) "Landlord", the owner or lessor of the premises or a person authorized by the owner to exercise any aspect of the management of the premises; (2) "Lease", a written or oral agreement for the use or possession of premises; (3) "Lessee", any person who leases premises from another to the exclusion of others during the rental or lease period and who is obligated to pay rent; (4) "Premises", land, tenements, condominium or cooperative units, air rights and all other types of real property leased under the terms of a rental agreement, including any facilities and appurtenances, to such premises, and any grounds, areas and facilities held out for the use of tenants generally or the use of which is promised to the tenant. "Premises" include structures, fixed or mobile, temporary or permanent, vessels, manufactured homes as defined in section 700.010, mobile trailer homes and vehicles which are used or intended for use primarily as a dwelling or as a place for commercial or industrial operations or storage; (5) "Rent", a stated payment for the temporary possession or use of a house, land or other real property, made at fixed intervals by a tenant or lessee to a landlord; (6) "Tenant", a person who occupies the premises with the landlord's consent.
Missouri Revised Statutes § 441.005 establishes the official definitions that apply throughout Missouri's landlord-tenant statutes, including chapters 441, 534, and 535. The provision broadly defines key terms such as 'landlord,' 'tenant,' 'lease,' 'premises,' 'rent,' and 'lessee,' setting the conceptual boundaries for how those words are interpreted in related laws. Notably, 'premises' is defined expansively to include not just traditional real property but also manufactured homes, mobile homes, vessels, and structures used as dwellings or for commercial purposes.
Plain English — not legal advice.
Under § 441.005, a 'landlord' includes not only the property owner but also any person the owner authorizes to manage any aspect of the premises, meaning property managers and agents may carry the same legal responsibilities as owners under Missouri's landlord-tenant chapters. Compliant operators generally ensure that anyone acting on their behalf understands they may be treated as a 'landlord' for purposes of chapters 441, 534, and 535. Because 'premises' is defined broadly, operators of manufactured home communities, mobile trailer parks, and similar facilities should be aware that these definitions likely apply to their operations as well.

Section § 441.005 defines a 'tenant' as anyone occupying premises with the landlord's consent, which means occupants in a wide range of housing situations—including manufactured homes and mobile units—may have rights and protections under Missouri's landlord-tenant statutes. Understanding how these foundational definitions apply can be important when evaluating whether a particular living arrangement falls under the protections of chapters 441, 534, or 535. Tenants who are uncertain whether their situation is covered by these definitions may find it helpful to consult a local tenant-rights organization or legal aid office for general guidance.
