Cal. Civ. Code § 8 CSR 60-4.040
Costs of Travel to Hearing
Operative Text
PURPOSE: This rule indicates that when a complainant has to travel for a hearing regarding a complaint of housing discrimination, the commission will cover the complainant’s travel expenses. (1) When a complainant files a complaint pursuant to sections 213.040, 213.041, 213.045, or 213.050, RSMo, or pursuant to section 213.070, RSMo, only as it relates to housing, and the respondent requests that a hearing be held in the county where he or she resides or does business, then, in the event that county is not the county of complainant’s residence, the commission will cover the costs associated with the complainant’s travel to the hearing pursuant to the state of Missouri’s policies and limits in place for state employees at the time the travel occurs. AUTHORITY: sections 213.030 and 213.075, RSMo 2000.* Original rule filed April 14, 2010, effective Oct. 30, 2010. *Original authority: 213.030, RSMo 1959, amended 1978, 1986, 1992, 1993, 1995, 1998 and 213.075, RSMo 1986, amended 1992.
Under Mo. Code Regs. tit. 8, § 8 CSR 60-4.040, when a housing discrimination complaint is filed under Missouri's human rights statutes and the respondent requests that the hearing take place in the county where the respondent resides or does business, the Missouri Commission on Human Rights will pay the complainant's travel costs to attend that hearing—provided the hearing county differs from the complainant's home county. Reimbursement follows the same travel policies and dollar limits that apply to Missouri state employees at the time of travel. This rule ensures that a respondent's venue choice does not impose uncompensated travel burdens on the person who brought the complaint.
Plain English — not legal advice.
Property owners and managers named as respondents in a Missouri housing discrimination proceeding should be aware that under 8 CSR 60-4.040, requesting a hearing in their own county of residence or business triggers the Commission's obligation to cover the complainant's travel expenses when that county differs from the complainant's. Compliant operators generally factor this procedural consequence into any venue-related decisions made during the complaint process. Understanding this rule helps respondents anticipate how hearing logistics are handled by the Commission.

Under 8 CSR 60-4.040, if you have filed a housing discrimination complaint with the Missouri Commission on Human Rights and the respondent requests a hearing in a county other than where you live, the Commission is responsible for covering your travel costs to attend that hearing in accordance with Missouri's state employee travel policies. This protection means that a respondent's venue request should not leave you bearing out-of-pocket travel expenses. Tenants who have questions about how travel reimbursement works in practice may wish to contact the Missouri Commission on Human Rights directly or reach out to a local tenant-rights organization for general guidance.
