Plain English

Mississippi Code Ann. § 89-7-71 establishes the official template for a bond that must be executed when a landlord pursues a rent attachment and the tenant's seized property is restored to them pending resolution. The bond requires a principal (typically the tenant) and at least two sureties to commit to paying double the amount claimed if the underlying rent or supply debt is not satisfied by a specified date. The statute also notes that when the attachment involves rent not yet due, the bond's language must be adjusted to fit that circumstance.

For Property Managers

Under Miss. Code Ann. § 89-7-71, when a landlord initiates a rent attachment proceeding and the tenant's property is released back to the tenant, a formal bond in the statutory form is required before that release occurs. Compliant operators in this process generally ensure that the bond correctly identifies the leased premises, the amount owed for rent and supplies, and the deadline for payment, with the penal sum set at double the claimed amount. Landlords involved in attachment proceedings typically work with the sheriff's office, which must formally approve the bond.

For Tenants

Miss. Code Ann. § 89-7-71 outlines the bond a tenant and their sureties must sign to secure the return of property seized under a rent attachment, committing to pay double the claimed amount if the debt is not resolved by the bond's deadline. Tenants in this situation have the right to have their property restored upon execution of the approved bond, and the bond's terms must accurately reflect the actual rent or supply amounts at issue. Tenants navigating an attachment proceeding may benefit from consulting a tenant-rights organization or legal aid provider to understand how the bond's obligations and the attachment process interact with their broader rights under Mississippi law.
