Minn. R. 4900 § 4900.0340
OCCUPANCY IN MULTIUNIT DEVELOPMENTS.
Operative Text
Initial occupancy in multiunit developments financed by the agency shall be limited to persons and families of low and moderate income; provided, however, that to the extent necessary to avoid economic loss resulting from inability to achieve full occupancy, and in order to encourage economic integration, a housing sponsor may, with the prior written approval of the commissioner, permit initial occupancy of up to 25 percent of the units in the housing project by persons and families who are not persons and families of low and moderate income. Preference for occupancy in multiunit developments financed by the agency may not be given to persons and families by virtue of their prior residence in the community in which the development is located; except that the housing sponsor may, with the prior written approval of the commissioner allow preference for persons and families displaced by public action or natural disaster or for previous residents of a rehabilitated multiunit development financed by the agency.
Minn. R. 4900 § 4900.0340 establishes two key occupancy rules for multiunit housing developments financed by the Minnesota Housing Finance Agency. First, these developments must primarily serve low- and moderate-income households, though up to 25 percent of units may be rented to higher-income residents if needed to maintain full occupancy and promote economic integration, but only with the commissioner's prior written approval. Second, the rule prohibits giving preference to applicants simply because they previously lived in the same community as the development, while carving out limited exceptions for people displaced by public action, natural disasters, or prior residents of a rehabilitated agency-financed building.

Housing sponsors operating multiunit developments under Minn. R. 4900 § 4900.0340 generally ensure that their tenant selection processes prioritize low- and moderate-income applicants as the primary pool. If a sponsor seeks to fill up to 25 percent of units with over-income residents or wishes to grant preference to displaced persons or former residents of a rehabilitated property, compliant operators obtain prior written approval from the commissioner before implementing those policies. Sponsors also take care that their marketing and waitlist procedures do not grant preference based on an applicant's prior residence in the surrounding community, as that practice is prohibited under this provision.

Under Minn. R. 4900 § 4900.0340, tenants and applicants at agency-financed multiunit developments have a right to a selection process that does not favor local community members over others based solely on prior neighborhood residence. Applicants who have been displaced by public action or a natural disaster, or who previously lived in a rehabilitated agency-financed building, may be entitled to a preference if the housing sponsor has received the commissioner's written approval to grant it. Those who believe a development's occupancy or preference policies may not comply with this provision can contact the Minnesota Housing Finance Agency or a local tenant-rights organization to understand available options.
