Minn. R. 4761 § 4761.2600 establishes notice requirements for emergency lead-related projects in Minnesota. When an emergency project starts during normal Department of Health business hours (8:00 a.m. to 4:30 p.m. on open days), a completed notice must reach the commissioner before work begins. When a project starts outside those hours, the notice must still be submitted as soon as possible, but no later than 4:30 p.m. on the next business day the department is open. Any amendments to an emergency project notice follow the procedures outlined in part 4761.2590, items B through D.
Plain English — not legal advice.
Property owners involved in emergency lead projects covered by Minn. R. 4761 § 4761.2600 are generally expected to ensure that a completed notice reaches the Minnesota Department of Health commissioner before work begins if the project starts during regular business hours. For projects that begin outside those hours, compliant operators typically submit the notice at the earliest opportunity and no later than 4:30 p.m. on the next day the department is open, using an accepted method such as mail, fax, delivery, or electronic submission. Keeping records of when and how notices were submitted—and following part 4761.2590 for any amendments—reflects standard practice for certified lead firms, lead supervisors, and property owners alike.

Minn. R. 4761 § 4761.2600 is designed to ensure that state regulators are promptly informed whenever an emergency lead-related project takes place in a property, which supports oversight of work that may affect residents' health. Tenants have an interest in knowing that these notice requirements exist, as they create a paper trail with the Minnesota Department of Health that can be referenced if questions arise about whether proper procedures were followed. Tenants who believe an emergency lead project was conducted without the required notice may consider contacting the Department of Health, consulting a tenant-rights organization, or exploring whether a violation of this provision is relevant to any existing dispute.
