Minn. R. 1300 § 1300.0090 establishes a municipal code enforcement agency called the "Department of Building Safety" and designates its head as the building official. Each municipality is responsible for appointing that building official in accordance with Minnesota Statutes, section 326B.133. This provision sets the administrative foundation for local building code enforcement rather than imposing specific obligations on property owners or occupants.
Plain English — not legal advice.
Under Minn. R. 1300 § 1300.0090, the Department of Building Safety is the local agency through which building code compliance is administered and enforced. Compliant property owners and managers generally direct permit applications, inspection requests, and code-related correspondence to this department and its designated building official. Knowing which municipal official holds that designation helps operators respond promptly to any notices or orders issued under the building code.

Minn. R. 1300 § 1300.0090 identifies the Department of Building Safety and its building official as the local authority responsible for enforcing the building code in a municipality. Tenants who believe a rental property has building code violations may have the option of filing a complaint with this department, raising code violations in relevant legal proceedings, or contacting a tenant-rights organization for guidance on available paths. The specific building official for a given municipality can typically be identified through the local government's official website or offices.
