Mich. Comp. Laws § § 554.639
Waiver prohibited.
Operative Text
Sec. 9. The requirements of this act may not be waived.
Section 554.639 of Michigan's Truth in Renting Act establishes that none of the protections or requirements created by the Act can be signed away or given up through a lease clause, agreement, or any other arrangement. This means that even if a lease contains language purporting to waive the Act's requirements, that language has no legal effect. The rule applies regardless of what either party may have agreed to in writing or verbally.

Under MCL § 554.639, property owners and managers cannot include lease provisions that attempt to waive any requirement of Michigan's Truth in Renting Act. Compliant operators review their lease agreements to ensure no clause purports to disclaim or override the Act's protections, as such clauses would be unenforceable. Awareness of this non-waiver rule is an important part of drafting and maintaining legally sound residential lease agreements in Michigan.

MCL § 554.639 means that tenants retain all rights granted by Michigan's Truth in Renting Act even if a lease clause appears to take those rights away. If a landlord attempts to enforce a lease provision that conflicts with the Act, tenants may be able to raise the non-waiver rule as a defense in a legal proceeding. Tenant-rights organizations and legal aid services can help explain how this provision may apply to a particular lease or dispute.
