Mich. Comp. Laws § § 600.5708
Rules.
Operative Text
Sec. 5708. Except as otherwise provided in this chapter, the procedure in summary proceedings shall be regulated by rules adopted by the supreme court and by local court rules not inconsistent therewith.
Michigan Compiled Laws § 600.5708 establishes that the procedural rules governing summary proceedings—such as eviction cases—are set by the Michigan Supreme Court through its court rules, supplemented by local court rules that must remain consistent with those statewide standards. This provision does not create substantive rights or obligations on its own; instead, it designates who has authority to shape how these proceedings unfold. Any exceptions to this framework are addressed elsewhere in the same chapter.
Plain English — not legal advice.
Under MCL § 600.5708, landlords initiating summary proceedings must follow the procedural rules established by the Michigan Supreme Court, as well as any applicable local court rules in the jurisdiction where the property is located. Compliant operators typically verify current court rules before filing, ensure all required forms and timelines are observed, and confirm that local rules do not impose additional requirements beyond the statewide baseline. Staying current with any rule amendments issued by the Supreme Court is a routine part of managing the process.

MCL § 600.5708 means that the procedures used in a summary proceeding—including an eviction action—are governed by Michigan Supreme Court rules and local court rules, giving tenants a defined procedural framework within which their case is heard. Tenants facing such proceedings may find it useful to review the applicable court rules to understand filing deadlines, hearing procedures, and response requirements. Local tenant-rights organizations or legal aid offices can help explain how these procedural rules apply in a particular court.
