Mich. Comp. Laws § § 125.1458d
Housing assistance; conditions.
Operative Text
Sec. 58d. The authority shall not provide assistance for housing under this chapter unless both of the following circumstances exist: (a) If the housing is multifamily housing, the owner or manager agrees in writing not to evict a tenant without just cause, as defined in section 44a of 1933 (Ex Sess) PA 18, MCL 125.694a. (b) The housing is sold or rented with a deed restriction, agreement, or other legal document that provides for the recapture of some or all of the assistance provided under this chapter upon terms and conditions specified in rules of the authority promulgated under section 58b(3).
Under MCL § 125.1458d, the Michigan State Housing Development Authority (MSHDA) is prohibited from providing housing assistance unless two conditions are met. First, if the property is multifamily housing, the owner or manager must commit in writing to evict tenants only for just cause, as that term is defined under MCL 125.694a. Second, regardless of housing type, the property must carry a deed restriction, agreement, or other legal instrument that allows the authority to recapture some or all of the assistance provided, under terms set by rules promulgated pursuant to section 58b(3).

Property owners and managers seeking MSHDA assistance under MCL § 125.1458d generally ensure that two compliance conditions are satisfied before assistance is granted. For multifamily properties, operators typically execute a written agreement committing to just-cause-only eviction standards as defined under MCL 125.694a. Additionally, compliant owners arrange for a deed restriction or equivalent legal document to be recorded against the property, establishing the authority's right to recapture assistance funds under the terms set by MSHDA's administrative rules.

MCL § 125.1458d creates meaningful protections for tenants living in MSHDA-assisted multifamily housing, most notably the requirement that owners agree in writing to evict only for just cause as defined under MCL 125.694a. Tenants in such housing may be able to raise the absence of just cause as a defense in eviction proceedings, since the owner's written commitment is a condition of receiving public assistance. Tenants who believe these protections are being violated can document the situation, review the deed restriction or assistance agreement on file with the authority, and consult a local tenant-rights organization or legal aid office for guidance on available options.
