Under MCL § 125.401 et seq. § 125.470, Section 70, residential buildings with two or more dwelling units must keep the floors and surrounding surfaces beneath and around toilets and sinks in good condition and proper repair. Where those surfaces are made of wood, they must additionally be kept painted with a light-colored paint. This rule applies to the physical maintenance of the structure itself, regardless of who occupies the unit.

MCL § 125.401 et seq. § 125.470, Section 70 places the maintenance obligation for floors and surfaces around toilets and sinks squarely on operators of two-family and multiple dwellings. Compliant property managers routinely inspect these areas for deterioration, promptly repair damaged or worn surfaces, and ensure that any wood flooring or surrounds in these areas are kept painted with light-colored paint. Keeping documentation of inspections and repair work is a common practice among operators seeking to demonstrate ongoing compliance.

Section 70 of MCL § 125.401 et seq. § 125.470 establishes a right for occupants of two-family and multiple dwellings to have floors and surfaces around toilets and sinks maintained in good repair. If these surfaces are deteriorating or unpainted wood is left exposed contrary to the provision's requirements, tenants may have grounds to raise the condition as a housing code violation. General enforcement paths can include notifying the local housing or building inspection authority, contacting a tenant-rights organization, or raising the violation in relevant legal proceedings.
