Cal. Civ. Code § 9
Section 9. An owner who has complied with sections 2 through 4, inclusive, which has not resulted in a purchase by the department or which has resulted in a sale pursuant to section 4, may apply to the department for a certificate of compliance by submitting a written request for the certificate in a form and with such documentation as required by the department to establish the owner's compliance to the satisfaction of the department. Upon submission of the written request, the owner shall provide a copy of the request to CEDAC and the chief executive officer of the affected municipality. Upon request by a tenant of the affected publicly-assisted housing, the owner shall provide a copy of the owner's request for a certificate of compliance. The department shall issue the certificate of compliance within 30 days after receipt of the application if it determines that the owner has complied with said sections 2 to 4, inclusive. The certificate of compliance shall be filed with the registry of deeds or the registry district of the land court of the county in which the real property is located within 1 year after the date of issuance.

Under Mass. Gen. Laws c. 40T § 9, once an owner has completed the notice and offer process required by sections 2 through 4 — and that process did not result in a state purchase or resulted in a qualifying sale — the owner may seek a certificate of compliance from the department. The department must issue the certificate within 30 days of receiving a complete application if it finds the owner met those requirements. Once issued, the certificate must be recorded with the appropriate registry of deeds or land court registry district within one year.

For Property Managers

Operators seeking to document compliance under Mass. Gen. Laws c. 40T § 9 generally submit a written application to the department in the required form, accompanied by documentation sufficient to establish that sections 2 through 4 were satisfied. A compliant operator also provides copies of that application to CEDAC and the chief executive officer of the affected municipality at the time of submission, and furnishes a copy to any tenant of the affected publicly-assisted housing who requests one. After the department issues the certificate, a compliant operator ensures it is filed with the correct registry of deeds or land court registry district within the one-year window specified in § 9.

For Tenants

Mass. Gen. Laws c. 40T § 9 gives tenants of affected publicly-assisted housing the right to request and receive a copy of the owner's application for a certificate of compliance, which can help tenants track whether the owner has followed the process required by sections 2 through 4. If a tenant believes the certificate was improperly issued or that the owner did not meet the underlying requirements, that concern can generally be raised with the department or a local rent board where applicable. Tenants seeking to understand their rights in this process may benefit from consulting a tenant-rights organization or legal aid provider familiar with Chapter 40T.
