Section 410.400 of the Massachusetts Sanitary Code requires that non-resident property owners post their contact information—including name, street address, and phone number—at the rental property, with additional details required depending on whether the owner is a corporation, trust, partnership, or uses a property manager. The posted phone number must be monitored at least once every 12 hours, unless an alternative emergency contact is provided for periods of absence. Owners must also provide or post the state-issued Notice of Occupants' Legal Rights and Responsibilities, and all postings must be on durable material of at least 20 square inches, placed near mailboxes or in another visible interior location.

For Property Managers

Under 105 CMR 410.400, compliant property operators who do not live on-site post a durable sign—at least 20 square inches—near the mailboxes or in a visible common area that includes the owner's full name, street address, and phone number, plus any required corporate officer, trustee, partner, or property manager contact details. Operators ensure the listed phone number is checked at minimum every 12 hours, or designate and communicate an alternative contact person and number when temporarily unavailable. Each occupant receives or has access to the Department-issued Notice of Occupants' Legal Rights and Responsibilities, satisfying the full posting and distribution requirements of this section.

For Tenants

Section 410.400 entitles occupants of Massachusetts rental properties to have clear, posted contact information for the non-resident owner or designated manager, as well as access to the state-issued Notice of Occupants' Legal Rights and Responsibilities. If this signage is missing, the phone number goes unmonitored, or the required notice has not been provided or posted, that may constitute a violation of the Sanitary Code that can be reported to the local board of health or inspectional services department. Tenants who believe 105 CMR 410.400 is not being followed may also consult a tenant-rights organization or legal aid office to understand the range of options available to them.
