Cal. Civ. Code § 8A-605
Md. Code Ann., Real Property Art. Title 8A — Mobile Homes
Operative Text
(a) (1) This subsection applies to a person who sells a mobile home and, in connection with the sale: (i) Is, or acts as an agent for, the owner of the park in which the home is to be located; and (ii) Negotiates with the buyer to place the home in a park. (2) Prior to the execution of a contract for the sale of a mobile home, the seller of the mobile home shall provide to the buyer a copy of any rules established under Subtitle 3 of this title by the owner of the park in which the mobile home is to be located. (3) A contract is unenforceable by a person described in paragraph (1) of this subsection if the person does not comply with paragraph (2) of this subsection. (b) If subsection (a) of this section does not apply, the seller shall provide the buyer with a notice, in writing, separate from the contract, and in substantially the following form: “If the mobile home you are purchasing is to be placed in a mobile home park, the park may have rules and lease provisions that affect you and your home. You should contact the park office to obtain and carefully review a copy of the lease and rules for the park before you enter into a contract to purchase a mobile home. Due to land use restrictions in many areas in this State, a mobile home may be placed only on property that is within a mobile home park.”
Maryland Code § 8A-605 establishes disclosure requirements that apply when a mobile home is sold and is intended to be placed in a mobile home park. When the seller is connected to the park—such as acting as the park owner's agent—the seller must give the buyer a copy of the park's rules before any contract is signed, and failure to do so makes the contract unenforceable against that seller. When the seller has no such park connection, the seller must still provide the buyer with a separate written notice explaining that park rules and lease terms may apply, and that mobile homes in Maryland are often restricted to placement within designated parks.
Plain English — not legal advice.
Operators and agents involved in mobile home sales under § 8A-605 generally ensure that park rules established under Subtitle 3 are delivered to prospective buyers before any purchase contract is executed. When a seller is acting on behalf of or as an agent of the park owner, maintaining documented proof of that pre-contract disclosure is a standard compliance practice, since a contract that omits this step is unenforceable by the seller. Sellers who are not affiliated with the park still typically provide the required standalone written notice—separate from the contract itself—informing buyers to review park leases and rules and to be aware of land-use restrictions.

As a mobile home buyer, § 8A-605 gives you the right to receive park rules before you sign a purchase contract when the seller is connected to the park, and if that disclosure is withheld, the contract cannot be enforced against you by that seller. Even when the seller has no park affiliation, you are entitled to a separate written notice reminding you to obtain and review the park's lease and rules before committing to a purchase. If you believe these disclosures were not provided, general enforcement paths include raising the violation as a defense in any contract dispute, consulting a tenant-rights or housing organization familiar with Maryland mobile home law, or seeking guidance from a licensed attorney.
