Under Md. Code Ann., Real Prop. § 8-601, either a landlord or a tenant who is a party to a District Court case brought under the landlord-tenant title or § 14-132 of the Real Property Article has the right to demand a jury trial, provided the amount of money at issue meets the threshold required for jury eligibility. For Property Managers

Property owners and managers involved in District Court proceedings under the landlord-tenant statutes should be aware that § 8-601 gives either party the right to request a jury trial when the amount in controversy clears the applicable threshold. Compliant operators generally track the dollar amounts at stake in any District Court action, since those figures determine whether a jury-trial demand is available. Understanding this procedural right can inform how a landlord-tenant case is prepared and managed from the outset.

For Tenants

Section 8-601 of the Maryland Real Property Code means that tenants, like landlords, may have the right to demand a jury trial in a District Court landlord-tenant case if the amount in controversy meets the required threshold. Tenants who believe this right applies to their situation can raise it as a procedural option within the District Court process, following the steps outlined in the relevant subtitle. Tenant-rights organizations and legal aid offices can help explain how the jury-trial demand process works under this provision.
