Cal. Civ. Code § 6-833
Md. Code Ann., Environment Art. Title 6, Subtitle 8 — Lead Poisoning Prevention Program
Operative Text
(a) For purposes of this section, a parent or legal guardian of a person at risk who is a minor is unavailable if, following reasonable efforts, the offeror is unable to locate or communicate with the parent or guardian of the minor. (b) (1) If a parent or legal guardian of the minor is unavailable, the offeror may: (i) Petition a court in accordance with the provisions of Title 13, Subtitle 7 of the Estates and Trusts Article to appoint a person to respond to the offer on behalf of the minor; and (ii) File the qualified offer with the court. (2) The court shall appoint a person to act on behalf of the minor within 15 days after the date of filing of the petition. (3) A person appointed to act on behalf of the minor shall file a response with the court either rejecting or accepting the qualified offer within 30 days after appointment by the court. (4) The response of the person appointed to respond to the offer on behalf of the minor is subject to approval by the court. (c) Within 15 days after a response to a qualified offer is filed with a court under subsection (b)(3) of this section, the court: (1) May hold a hearing; and (2) Shall approve or disapprove the response to the qualified offer. (d) If a court disapproves the response to the qualified offer filed by the person acting on behalf of the minor, the court may order: (1) That an additional response be filed on behalf of the minor; or (2) Any action the court considers necessary and appropriate to protect the interests of the minor. (e) If the court approves a response accepting a qualified offer on behalf of the minor, the order of the court shall designate one or more persons who shall be responsible for and authorized to make all decisions on behalf of the minor necessary to implement the qualified offer.
Under Md. Code Ann., Env. §§ 6-801 to 6-852 § 6-833, when a minor is considered a 'person at risk' in a lead-paint remediation context and that minor's parent or legal guardian cannot be located after reasonable efforts, Maryland law establishes a court-supervised process for handling a qualified offer on the minor's behalf. A court-appointed representative must respond to the offer within 30 days, and the court itself must approve or disapprove that response within 15 days of filing. If the court disapproves the response, it can require an additional response or take other steps it deems necessary to protect the minor's interests.
Plain English — not legal advice.
Property owners or managers making a qualified offer under Md. Code Ann., Env. §§ 6-801 to 6-852 § 6-833 who cannot locate a minor's parent or guardian after reasonable efforts have a defined legal pathway: they may petition a court to appoint a representative for the minor and file the qualified offer with that court. Compliant offerors document their outreach attempts thoroughly to demonstrate that 'reasonable efforts' were made before invoking the court process. Once a court-appointed representative accepts an offer and the court approves, the court's order will designate the person or persons authorized to make all implementation decisions on the minor's behalf.

For minors who are persons at risk under Md. Code Ann., Env. §§ 6-801 to 6-852 § 6-833, this provision ensures that a qualified offer cannot simply be accepted or rejected without court oversight when a parent or guardian is unavailable. The court must approve any response made on the minor's behalf, and if it disapproves, it can order further action to protect the minor's interests. Families or advocates who believe a minor's interests are not being properly represented in this process may wish to consult a tenant-rights organization or legal aid provider familiar with Maryland environmental and housing law.
