Me. Rev. Stat. tit. 10, ch. 953 § 9095
Restrictions on the purchase of fuel oil or bottled gas
Operative Text
Except as provided in subsection 1 , no mobile home park owner or operator may require, as a condition of tenancy or continued tenancy, that a mobile home owner or dweller purchase fuel oil or bottled gas from any particular fuel oil or bottled gas dealer or distributor. 1. Centralized distribution system. This section does not apply to a mobile home park owner or operator who provides a centralized distribution system for fuel oil or bottled gas, or both, for residents in the park. No mobile home park owner or operator who provides such a centralized distribution system may charge residents more than the average retail price charged by other retail distributors for fuel oil or bottled gas in the county in which the mobile home park is located.
Under 10 M.R.S. §§ 9091–9095, mobile home park owners and operators generally cannot make a tenant's right to live in the park contingent on buying fuel oil or bottled gas from a specific supplier. An exception exists when the park itself operates a centralized distribution system for those fuels, but even then the park may not charge residents more than the average retail price for those fuels in the same county. The rule is designed to protect residents from being locked into a single, potentially overpriced fuel source as a condition of their housing.
Plain English — not legal advice.
Under 10 M.R.S. §§ 9091–9095, a compliant mobile home park operator does not include any lease term or informal requirement that residents purchase fuel oil or bottled gas from a designated dealer. Operators who choose to run a centralized fuel distribution system must monitor county-wide average retail prices and keep their charges at or below that benchmark. Maintaining documentation of local retail fuel prices is a common practice for operators who offer centralized distribution, as it supports demonstrating compliance with the pricing cap.

10 M.R.S. §§ 9091–9095 gives mobile home park residents the right to choose their own fuel oil or bottled gas supplier, unless the park operates a centralized distribution system. If a park does run such a system, residents are protected from being charged above the average retail price for those fuels in the county. Tenants who believe a park is violating either the supplier-choice rule or the pricing cap may consider documenting the conduct, contacting a Maine tenant-rights organization, or reaching out to the Maine Attorney General's consumer protection office to understand available options.
