Under 10 M.R.S. §§ 9081–9088, Maine's office responsible for licensing manufactured housing communities may accept inspections carried out by municipal inspectors rather than conducting every inspection itself, but only when specific conditions are satisfied. The municipality must have adopted standards approved by the state office, the municipal inspector must hold certification from the Commissioner of Health and Human Services, and the municipality must submit inspection reports to the state on a monthly basis. Licenses issued through this municipal-inspection pathway carry the same display, renewal, and compliance obligations as those issued after a direct state inspection.

For Property Managers

Operators of manufactured housing communities subject to 10 M.R.S. §§ 9081–9088 should be aware that their license may be issued on the basis of a municipal inspection rather than a direct state inspection, provided the municipality's standards have been approved by the state office. Compliant operators generally ensure that any license obtained through this pathway is displayed and renewed on the same schedule as a standard state-issued license. Because the state office retains the authority to conduct its own follow-up inspections to verify that the intent of the statutes is being followed, maintaining ongoing compliance with both municipal and state standards is a characteristic of well-run communities.

For Tenants

Residents of manufactured housing communities covered by 10 M.R.S. §§ 9081–9088 should know that even when a community is inspected by a municipal inspector rather than the state, the state office retains oversight authority and can conduct its own inspections to verify compliance. The municipality is required to send inspection reports to the state office monthly, which means records of inspections are available through official channels. Tenants who have concerns about whether a community's license or inspection process meets state requirements may contact the state office directly or reach out to a tenant-rights organization for general guidance on available options.
