Definitions
Operative Text
As used in this subchapter, unless the context otherwise indicates, the following terms have the following meanings. 1. Manufactured home. "Manufactured home" means a structure, transportable in one or more sections, that is 8 body feet or more in width and is 32 body feet or more in length and that is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities and includes the plumbing, heating, air conditioning and electrical systems contained therein. 2. Manufactured housing community. "Manufactured housing community" means a parcel or adjoining parcel of land, under single ownership, that has been planned and improved for the placement of 3 or more manufactured homes, but does not include a construction camp. 3. Sanitarian. 4. Controlling interest. "Controlling interest" means: A. In the case of a corporation, more than 50% of the total combined voting power of all classes of stock of the corporation entitled to vote or more than 50% of the capital, profits or beneficial interest in the voting stock of the corporation; and B. In the case of a partnership, association, trust or other entity, more than 50% of the capital, profits or beneficial interest in the partnership, association, trust or other entity. For the purposes of this subchapter, to determine whether a purchase or acquisition of a controlling interest has taken place, all actions of persons acting in concert are aggregated. Persons must be treated as acting in concert when they have a relationship with each other such that one person influences or controls the actions of another through common ownership. 5. Purchase of manufactured housing community. "Purchase of a manufactured housing community" means the purchase or acquisition of a manufactured housing community or of the direct or indirect controlling interest in the owner of a manufactured housing community. 6. Purchaser of manufactured housing community. "Purchaser of a manufactured housing community" means a person that purchases or acquires a manufactured housing community or a direct or indirect controlling interest in the owner of a manufactured housing community. 7. Sale of manufactured housing community. "Sale of a manufactured housing community" means any sale or transfer of a manufactured housing community or of the direct or indirect controlling interest in the owner of a manufactured housing community.
Section 9081 of Maine's manufactured housing subchapter establishes the foundational vocabulary used throughout the law. It defines key terms such as 'manufactured home,' 'manufactured housing community,' 'controlling interest,' and related transaction terms like 'purchase' and 'sale' of a manufactured housing community. Notably, a 'sale' or 'purchase' under § 9081 includes not just direct property transfers but also acquisitions of more than 50% ownership stakes in the entity that owns the community, and the law aggregates the actions of persons acting in concert when determining whether such a threshold has been crossed. These definitions set the scope for which properties, owners, and transactions the rest of the subchapter governs.
Plain English — not legal advice.
Operators and owners of manufactured housing communities in Maine should be familiar with the definitions in § 9081, because they determine whether a given property or transaction falls under the subchapter's requirements. A community qualifies if it consists of three or more manufactured homes on a parcel or adjoining parcels under single ownership. Owners contemplating a sale or restructuring of ownership interests—including indirect transfers through corporate stock or partnership interests—should recognize that such transactions may constitute a 'sale of a manufactured housing community' under § 9081, triggering obligations elsewhere in the subchapter.

Residents of manufactured housing communities in Maine benefit from knowing that § 9081 broadly defines what counts as a 'sale' of their community, including behind-the-scenes ownership changes where a controlling interest (more than 50%) in the owning entity changes hands. This broad definition means that protections found elsewhere in the subchapter may apply even when the land itself is not directly sold. Tenants who believe a change in community ownership has occurred can consult a tenant-rights organization or Maine legal aid to understand whether the transaction qualifies under § 9081 and what rights may be triggered as a result.
