94-348 Me. Code R. ch. 8 § 8.01
GENERALLY
Operative Text
A. Purpose Pursuant to Title 5 M.R.S.A. §4566(7), the Maine Human Rights Commission has adopted the following regulations which are designed to inform owners, lessees, sublessees, managing agents and other interested parties of the Commission’s interpretation of the Maine Human Rights Act, Title 5 M.R.S.A. §4551, et seq., hereinafter referred to as “the Act.” B. Effect The regulations shall be accorded the full force and effect of interpretative administrative regulations. C. Construction (1) Consistent with the public policy underlying the Act (as expressed in §4552), and with firmly established principles for the interpretation of such humanitarian legislation, the remedial provisions of the Act shall be given broad construction and its exceptions shall be construed narrowly. (2) The provisions of these regulations are severable. If any provision or the application of any provision of these regulations to any person or circumstances is invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application.
Section 8.01 of 94-348 Code of Maine Rules ch. 8 establishes the purpose, legal effect, and interpretive framework for the Maine Human Rights Commission's housing regulations. These rules are designed to explain how the Commission interprets the Maine Human Rights Act as it applies to housing, and they carry the full weight of official administrative interpretations. The regulations are written to be read broadly in favor of protecting rights, while any exceptions to those protections are to be read narrowly. Individual provisions stand independently, so if one part is found invalid, the rest of the regulations remain in effect.

Under 94-348 Code of Maine Rules ch. 8 § 8.01, property owners, lessees, managing agents, and other housing operators are the intended audience for these regulations, which reflect the Maine Human Rights Commission's official reading of the Maine Human Rights Act. Compliant operators generally familiarize themselves with these rules as authoritative guidance on fair housing obligations in Maine, understanding that the Commission applies them with a broad, protective lens. Because exceptions to the Act's requirements are construed narrowly under § 8.01, operators typically avoid relying on exemptions without a clear and well-documented basis.

Section 8.01 of 94-348 Code of Maine Rules ch. 8 signals that the Maine Human Rights Commission interprets the Maine Human Rights Act's protections expansively and its exceptions restrictively, which generally benefits people asserting housing discrimination claims. Tenants and prospective tenants can look to these regulations as the Commission's official interpretive framework when evaluating whether their rights under the Act may have been affected. Those who believe they have experienced housing discrimination may consider contacting the Maine Human Rights Commission directly, reaching out to a tenant-rights organization, or consulting with an attorney familiar with Maine fair housing law.
