La. Stat. Ann. § R.S. 46:1959
Scope of Chapter
Operative Text
§1959. Scope of Chapter Nothing in this Chapter shall be construed to amend, repeal, conflict with, or supersede any federal or state law, rule, or regulation or local ordinance mandating full and equal access in the use of public facilities or places, common carriers, public conveyances, or other modes of transportation, or housing accommodations for a person with a disability. Acts 1993, No. 482, §1; Acts 2014, No. 492, §1; Acts 2014, No. 811, §24, eff. June 23, 2014. NOTE: Acts 1993, No. 763, §1 amended prior R.S. 46:1952(A), (B), and (C), 1953(D), and 1954 and enacted R.S. 46:1953(E). Acts 1993, No. 482, §1 amended and reenacted the entire Chapter. The Chapter appears as in Act No. 482. The Louisiana State Law Institute printed the provisions of Act No. 763 as a note at the head of this Chapter.
La. R.S. § 46:1959 establishes that the chapter containing it does not override, repeal, or conflict with any existing federal, state, or local law that guarantees full and equal access to public facilities, transportation, or housing for people with disabilities. In other words, this provision acts as a savings clause, preserving the force of all other disability-access mandates already on the books. The chapter's own rules are meant to coexist with — not diminish — those broader protections.
Plain English — not legal advice.
Property owners and managers operating under this chapter should understand that La. R.S. § 46:1959 preserves all pre-existing disability-access obligations in housing accommodations. A compliant operator continues to follow every applicable federal, state, and local fair-housing and accessibility requirement regardless of anything else stated in this chapter. Familiarity with overlapping laws — such as the Fair Housing Act and Louisiana's own accessibility statutes — remains part of standard operational practice.

La. R.S. § 46:1959 makes clear that tenants with disabilities retain every right granted by other federal, state, and local laws, even when this chapter is at issue. If a housing provider appears to be using this chapter to justify limiting accessibility accommodations, that argument is expressly foreclosed by this savings clause. Tenants can explore their options by contacting a local tenant-rights organization, a fair-housing agency, or a legal aid office familiar with disability-access law.
