La. Stat. Ann. § R.S. 40:503
Continued occupancy after termination of eligibility
Operative Text
§503. Continued occupancy after termination of eligibility Households who are already in occupancy or are receiving assistance but who become ineligible for occupancy or other assistance may continue their occupancy or receipt of other assistance at the discretion of the local housing authority for such period, upon such terms and conditions, and, in the case of continued occupancy, in exchange for such rent, not less than any applicable minimum rent, as the authority shall determine to be appropriate.
Under La. R.S. § 40:503, when a household living in public housing or receiving housing assistance loses its eligibility—whether due to income changes, household composition, or other factors—it does not automatically have to leave immediately. Instead, the local housing authority has discretionary power to allow that household to remain in its unit or continue receiving assistance for a period it deems appropriate, under conditions and at a rent level it sets, provided that rent is no lower than any applicable minimum. The rule establishes that continued occupancy or assistance after ineligibility is a matter of authority discretion, not an automatic right.
Plain English — not legal advice.
Local housing authorities operating under La. R.S. § 40:503 generally document the circumstances under which a household has become ineligible and then make a formal, recorded determination about whether to extend occupancy or assistance, for how long, and on what terms. Compliant authorities set any continued-occupancy rent at or above the applicable minimum rent threshold and apply consistent, written criteria when exercising this discretion across similarly situated households. Maintaining clear records of each determination helps demonstrate that the authority's decisions are reasoned and applied equitably.

If your household loses eligibility for public housing or housing assistance, La. R.S. § 40:503 means the local housing authority may—but is not required to—allow you to remain in your unit or continue receiving assistance for a period it determines. Households in this situation can ask the housing authority to explain the basis for any decision it makes about continued occupancy, including the rent amount and any conditions attached. Tenant-rights organizations and legal aid offices familiar with Louisiana housing law can help you understand what procedural protections may apply when an authority exercises this discretion.
