La. Stat. Ann. § R.S. 40:385
Benefits not a right
Operative Text
§385. Benefits not a right No person shall have any claim or entitlement to enjoyment of any benefit conferred by this Chapter, including but not limited to any tenancy in any development, as a matter of right. All benefits conferred shall be pursuant to the conditions and qualifications established by this Chapter and by the rules and regulations of the local housing authority administering it. Further, the benefits of this Chapter are necessarily limited by the resources available to each local housing authority of this state. Consequently, all persons who might otherwise be eligible may not receive a benefit. Further, those receiving benefits may receive the same only on a temporary basis or for a limited period of time.
Under La. R.S. § 40:385, no individual has an automatic legal right to housing assistance or any other benefit provided by Louisiana's public housing statutes. Eligibility alone does not guarantee receipt of a benefit, because available resources at each local housing authority limit how many people can be served. Benefits that are granted may be provided only temporarily or for a defined period, and all benefits are subject to the conditions set by the governing rules and regulations.
Plain English — not legal advice.
La. R.S. § 40:385 makes clear that local housing authorities operate under resource constraints and are not obligated to provide benefits to every eligible applicant. Property owners and managers participating in public housing programs generally maintain awareness that tenancy arrangements in assisted developments are governed by the authority's rules and regulations, not by any inherent entitlement of the resident. Compliant operators typically document the conditional and time-limited nature of any assisted tenancy in accordance with the administering authority's requirements.

La. R.S. § 40:385 establishes that housing benefits under this chapter are not guaranteed as a matter of right, meaning eligibility does not automatically translate into receiving assistance or a tenancy. Benefits may be limited in duration or subject to conditions set by the local housing authority administering the program. Tenants who believe their benefits were improperly denied or terminated may consider contacting their local housing authority for clarification, reaching out to a tenant-rights organization, or consulting with a legal aid provider familiar with Louisiana housing law.
