Plain English

Kentucky Revised Statute § 383.190 addresses a narrow situation in which a life tenant (someone who holds property only for the duration of their own life) has leased that property to another person on a year-to-year basis and then dies after March 1. Under this rule, the lessee is not immediately displaced by the life tenant's death; instead, the lessee may remain on the land through December 31 of that same year. From the moment of the life tenant's death, however, the lessee owes a reasonable rent to whoever succeeds to the property interest.

For Property Managers

Property owners and estate administrators dealing with a life tenancy situation governed by Ky. Rev. Stat. § 383.190 should be aware that a lessee's right to occupy through December 31 is established by statute when the life tenant dies after March 1. Compliant operators in this context typically document the date of the life tenant's death, identify the party now entitled to receive rent, and communicate promptly with the lessee regarding the reasonable rent obligation that begins at the moment of death. Keeping clear records of any rent collected before and after the life tenant's death helps ensure an orderly transition of the property interest.

For Tenants

Under Ky. Rev. Stat. § 383.190, a lessee who was renting from a life tenant has a statutory right to remain on the land through December 31 if the life tenant dies after March 1, providing meaningful protection against immediate displacement. That right comes with an obligation: reasonable rent is owed from the date of the life tenant's death, payable to whoever now holds the property interest. Tenants in this situation may wish to consult a tenant-rights organization or legal aid office to understand how 'reasonable rent' might be determined and what documentation of payments is advisable during the transition period.
