367.110 Definitions for KRS 367.170 to 367.300. As used in KRS 367.170 to 367.300: (1) "Person" means natural persons, corporations, trusts, partnerships, incorporated or unincorporated associations, and any other legal entity. (2) "Trade" and "commerce" means the advertising, offering for sale, or distribution of any services and any property, tangible or intangible, real, personal or mixed, and any other article, commodity, or thing of value, and shall include any trade or commerce directly or indirectly affecting the people of this Commonwealth. (3) "Documentary material" means the original or a copy of any book, record, report, memorandum, paper, communication, tabulation, map, chart, photograph, mechanical transcription, or other tangible document or recording. (4) "Examination" of documentary material shall include the inspection, study, or copying of any such material, and the taking of testimony under oath or acknowledgment in respect of any such documentary material or copy thereof. History: Created 1972 Ky. Acts ch. 4, sec. 6.
Kentucky Revised Statutes § 367.110 establishes the foundational definitions that apply throughout the state's consumer protection provisions found in KRS 367.170 to 367.300. The statute broadly defines key terms — including 'person,' 'trade and commerce,' 'documentary material,' and 'examination' — to ensure that the rules governing unfair or deceptive practices cover a wide range of entities, transactions, and investigative activities. By defining 'trade and commerce' to include any activity directly or indirectly affecting Kentucky residents, the provision signals that housing-related advertising, leasing, and services fall within the scope of these consumer protection laws.
Plain English — not legal advice.
Property owners and managers operating in Kentucky should be aware that KRS § 367.110 defines the scope of terms used throughout KRS 367.170 to 367.300, the state's consumer protection framework. Because 'trade and commerce' is defined broadly to include the advertising and offering of real property and related services, rental housing activities — including how units are marketed and leased — can fall within this regulatory scheme. Operators who maintain clear records and transparent advertising practices are generally better positioned to demonstrate compliance if documentary materials are ever subject to examination under this framework.

Kentucky's KRS § 367.110 sets out the definitions that underpin the consumer protection rules in KRS 367.170 to 367.300, which can apply to rental housing transactions. Because 'person' is defined broadly to include corporations and other legal entities, these protections are not limited to dealings with individual landlords — they can extend to property management companies and other business structures. Tenants who believe they have encountered unfair or deceptive practices in connection with renting a home may find it useful to consult a tenant-rights organization or the Kentucky Attorney General's office to understand how these definitions affect their situation.
