Ky. Rev. Stat. ch. 344 § 344.670
Civil action by commission on behalf of aggrieved person electing judicial
Operative Text
344.670 Civil action by commission on behalf of aggrieved person electing judicial proceeding. (1) If an election is made under KRS 344.635 for a judicial rather than an administrative proceeding, the commission shall not later than thirty (30) days after the election is made, commence and maintain a civil action on behalf of the aggrieved person in the appropriate Circuit Court seeking relief under this section. (2) Any aggrieved person with respect to the issues to be determined in a civil action under this section may intervene as of right in that civil action. (3) If the court finds that a discriminatory housing practice has occurred or is about to occur, the court may grant as relief any relief under KRS 344.660 which a court could grant with respect to a discriminatory housing practice in a civil action under KRS 344.650. Any relief granted under KRS 344.660 that would accrue to an aggrieved person in a civil action commenced by that aggrieved person under KRS 344.650 shall also accrue to that aggrieved person in a civil action under this section. If monetary relief is sought for the benefit of an aggrieved person who does not intervene in the civil action, the court shall not award relief if that aggrieved person has not complied with discovery orders entered by the court.
Kentucky Revised Statute § 344.670 establishes a process by which the Kentucky Commission on Human Rights can file and pursue a civil lawsuit in Circuit Court on behalf of a person who has chosen a judicial—rather than administrative—path to address a discriminatory housing practice. The Commission must initiate this action within 30 days of that election. If a court finds that discrimination has occurred or is about to occur, it may award the same range of relief available in a privately filed civil action, including monetary remedies, though monetary awards for a non-intervening aggrieved person can be withheld if that person fails to comply with court-ordered discovery.

Under Ky. Rev. Stat. § 344.670, a property owner or manager facing a fair housing complaint should be aware that the Kentucky Commission on Human Rights has the authority to bring a civil action in Circuit Court on an aggrieved person's behalf, and that the full range of civil remedies—including monetary relief—can be sought in that forum. Operators who maintain thorough, consistent documentation of their housing policies and practices are generally better positioned to respond to discovery requests and court proceedings. Understanding that § 344.670 proceedings carry the same remedial scope as privately initiated civil actions underscores the importance of fair and uniform application of rental policies.

Ky. Rev. Stat. § 344.670 gives individuals who have elected a judicial proceeding under KRS 344.635 the right to have the Kentucky Commission on Human Rights file and maintain a civil lawsuit on their behalf within 30 days of that election. Aggrieved persons also have an explicit right to intervene directly in that civil action, allowing them to participate in the proceedings. Those seeking monetary relief who choose not to intervene should be aware that the court may decline to award such relief if they do not comply with discovery orders; tenant-rights organizations or legal aid offices can help explain what participation in the process generally involves.
