Ky. Rev. Stat. ch. 344 § 344.610
Breach of conciliation agreement
Operative Text
344.610 Breach of conciliation agreement. (1) When the commission has probable cause to believe that a respondent has breached a conciliation agreement arising from a discriminatory housing practice, the commission shall reach an agreement for the respondent to voluntarily come into compliance or file an action in Circuit Court pursuant to KRS 344.665. (2) A civil action for breach shall be commenced within ninety (90) days of the commission receiving notice of the breach.
Kentucky Revised Statutes § 344.610 addresses what happens when a party (the respondent) is believed to have broken a conciliation agreement that was reached to resolve a fair housing complaint. Under this provision, the Kentucky Commission on Human Rights must first attempt to bring the respondent back into voluntary compliance; if that fails, the Commission may file a civil action in Circuit Court. Any such civil action must be initiated within 90 days of the Commission learning about the breach.
Plain English — not legal advice.
Property owners and managers who enter into conciliation agreements to resolve fair housing complaints under Ky. Rev. Stat. § 344.610 are generally expected to fulfill every term of those agreements fully and on time. A compliant operator keeps records demonstrating adherence to the agreement's conditions, since the Commission monitors compliance and holds authority to pursue court action if a breach is suspected. Understanding that the Commission operates under a 90-day filing window once it receives notice of a breach underscores the importance of proactive communication if circumstances affecting compliance arise.

Ky. Rev. Stat. § 344.610 provides a mechanism to protect the outcomes that tenants or complainants secured through conciliation agreements in fair housing cases. If a respondent fails to honor such an agreement, the Kentucky Commission on Human Rights can seek voluntary compliance or pursue a civil action in Circuit Court within 90 days of learning of the breach. Individuals who believe a conciliation agreement is being violated may consider notifying the Commission directly or reaching out to a local tenant-rights organization to understand available options.
