Ky. Rev. Stat. ch. 344 § 344.450
Civil remedies for injunction and damages
Operative Text
344.450 Civil remedies for injunction and damages. Any person injured by any act in violation of the provisions of this chapter shall have a civil cause of action in Circuit Court to enjoin further violations, and to recover the actual damages sustained, together with the costs of the law suit. The court's order or judgment shall include a reasonable fee for the plaintiff's attorney of record and any other remedies contained in this chapter.
Kentucky Revised Statute § 344.450 establishes a private right of action for individuals who have been harmed by a violation of the state's civil rights and fair housing chapter. An injured person may go to Circuit Court to stop ongoing violations through an injunction and to seek compensation for actual damages they have suffered. If the court rules in the plaintiff's favor, the judgment must also include a reasonable attorney's fee for the plaintiff's lawyer, along with any other remedies available under the chapter.
Plain English — not legal advice.
Property owners and managers operating in Kentucky should be aware that § 344.450 empowers individuals who believe they have been harmed by a fair housing or civil rights violation to bring a lawsuit directly in Circuit Court. A compliant operator generally maintains consistent, documented policies and practices that align with the requirements of Kentucky's civil rights chapter, reducing exposure to claims for injunctive relief, actual damages, and mandatory attorney's fees. Understanding that a court judgment under this provision must include the plaintiff's attorney's fees underscores the financial stakes of non-compliance.

Under Ky. Rev. Stat. § 344.450, a person who has been injured by a violation of Kentucky's civil rights and fair housing laws has the right to file a civil lawsuit in Circuit Court seeking to stop the harmful conduct and recover actual damages. This provision also entitles a prevailing plaintiff to have their attorney's fees covered as part of the court's order, which can make it more accessible to pursue a claim. Tenants who believe their rights under this chapter have been violated may wish to consult a tenant-rights organization or legal aid office to understand the range of remedies and enforcement paths available to them.
