Ky. Rev. Stat. ch. 344 § 344.385
Notice of violation by real estate dealer to be given Real Estate
Operative Text
344.385 Notice of violation by real estate dealer to be given Real Estate Commission -- Notice of violation to state or federal licensing agency. (1) Where a real estate broker or a real estate salesman has failed to comply with an order issued by the commission or has been found to have committed an unfair housing practice in violation of KRS 344.380, the commission shall notify in writing the Real Estate Commission of the Commonwealth of Kentucky of the failure to comply or violation. (2) In the case of an order with respect to a discriminatory housing practice that occurred in the course of a business subject to licensing or regulation by a state or federal government agency, the commission shall, not later than thirty (30) days after the date of the issuance of the order, or if the order is judicially reviewed, thirty (30) days after the order is in substance affirmed upon review: (a) Send copies of the finding of fact, conclusions of law, and the order to that governmental agency; and (b) Recommend to that governmental agency appropriate disciplinary action, including, where appropriate, the suspension or revocation of the license of the respondent.
Kentucky Revised Statutes § 344.385 establishes a cross-agency notification requirement when a real estate broker or salesperson violates fair housing rules. When such a professional fails to comply with a commission order or is found to have committed an unfair housing practice under KRS 344.380, the enforcing commission must notify the Kentucky Real Estate Commission in writing. Additionally, when the discriminatory practice occurred within a licensed or regulated business, the commission must send its findings and order to the relevant state or federal licensing agency within 30 days—and must recommend appropriate disciplinary action, which can include suspension or revocation of the respondent's license.

Real estate brokers and salespersons operating as landlords or property managers should be aware that under Ky. Rev. Stat. § 344.385, a finding of an unfair housing practice does not stay within a single agency. Compliant operators generally ensure that all staff involved in housing transactions are trained on fair housing obligations under KRS 344.380, since a violation can trigger notifications to the Kentucky Real Estate Commission and potentially to other licensing bodies. Operators who hold state or federal licenses in related fields should understand that those licenses may be subject to disciplinary review as a direct consequence of a fair housing violation finding.

Ky. Rev. Stat. § 344.385 provides tenants with an important layer of accountability when a real estate professional is involved in a discriminatory housing practice. If a broker or salesperson is found to have violated fair housing rules, the law requires that their professional licensing authorities be notified and that disciplinary action—including possible license suspension or revocation—be recommended. Tenants who believe they have experienced discrimination by a licensed real estate professional may explore filing a complaint with the relevant civil rights or housing commission, or consult a tenant-rights organization to understand how this cross-agency reporting process under § 344.385 might apply to their situation.
