Ky. Rev. Stat. ch. 344 § 344.370
Unlawful financial practices
Operative Text
344.370 Unlawful financial practices. It is an unlawful practice for a financial institution or for any person or other entity whose business includes engaging in real estate-related transactions: (1) To discriminate against an individual because of the race, color, religion, or national origin, familial status, disability, sex, or age of the individual or the present or prospective owner, tenant, or occupant of the real property or of a member, stockholder, director, officer, employee, or representative of any of these, in the granting, withholding, extending, modifying, or renewing the rates, terms, conditions, privileges, or other provisions of financial assistance or in the extension of services in connection therewith; (2) To use a form of application for financial assistance or to make or keep a record or inquiry in connection with applications for financial assistance which indicate, directly or indirectly, a limitation, specification, or discrimination as to race, color, religion, familial status, disability, or national origin or an intent to make such a limitation, specification, or discrimination; (3) To discriminate by refusing to give full recognition, because of sex, to the income of each spouse or the total income and expenses of both spouses where both spouses become or are prepared to become joint or several obligors in real estate transactions; or (4) As used in this section, the term "real estate-related transaction" means any of the following: (a) The making or purchasing of loans or providing other financial assistance; 1. For purchasing, constructing, improving, repairing, or maintaining a housing accommodation; or 2. Secured by real estate. (b) The selling, brokering, or appraising of real property except that a person engaged in the business of furnishing appraisals of real property may take into consideration factors other than race, color, religion, national origin, sex, disability, or familial status.
Kentucky Revised Statute § 344.370 prohibits financial institutions and businesses involved in real estate-related transactions from discriminating on the basis of race, color, religion, national origin, familial status, disability, sex, or age when making decisions about loans, financial assistance, or related services. The law also bars the use of application forms or record-keeping practices that signal or reflect discriminatory intent based on those protected characteristics. Additionally, § 344.370 specifically forbids lenders from discounting or ignoring a spouse's income solely because of sex when both spouses are applying as joint or several obligors.

Property owners and managers who engage in real estate-related financial transactions — such as arranging financing or working with lenders on behalf of tenants or buyers — should be aware that Ky. Rev. Stat. § 344.370 sets firm boundaries on how financial decisions may be made and documented. Compliant operators ensure that any application forms, records, or inquiries used in connection with financial assistance contain no language that directly or indirectly signals a preference, limitation, or exclusion based on protected characteristics. When transactions involve married co-applicants, operators working with lenders generally confirm that both spouses' incomes are given full and equal consideration as required under § 344.370(3).

Ky. Rev. Stat. § 344.370 gives individuals the right to be free from discriminatory treatment by financial institutions and real estate transaction businesses when seeking loans or financial assistance related to housing. If a tenant or prospective buyer believes a lender has discriminated against them — for example, by offering different terms based on race, national origin, disability, or by discounting a spouse's income based on sex — that person may have grounds to raise a violation under § 344.370. General enforcement paths can include filing a complaint with the Kentucky Commission on Human Rights, contacting the U.S. Department of Housing and Urban Development, or reaching out to a tenant-rights or fair-housing organization for guidance on available options.
