Plain English

Under Kan. Stat. Ann. §§ 58-2501–58-2533, lease agreements for agricultural land that impose an excessive combination of burdensome requirements are declared contrary to Kansas public policy, illegal, and unenforceable. When such a lease is found invalid, tenants are still obligated to pay only a fair and reasonable amount as rent for the land itself. Any lien the landlord may hold is limited to the total crops grown, livestock raised on share or lease, and receipts from pasture use—including a lien on the tenant's livestock sufficient to cover pasturage charges on the landlord's land.

For Property Managers

Landlords operating under Kan. Stat. Ann. §§ 58-2501–58-2533 should be aware that agricultural lease agreements stacking multiple onerous obligations risk being declared unenforceable under Kansas law. Compliant operators generally structure their lease terms so that rent obligations reflect fair and reasonable compensation for the land, avoiding provisions that courts or parties might characterize as collectively burdensome. Lien rights in a compliant lease are typically confined to crops grown, livestock raised under the lease arrangement, and pasture-related receipts and livestock, rather than extending beyond those categories.

For Tenants

Kan. Stat. Ann. §§ 58-2501–58-2533 provides agricultural tenants a basis to challenge lease agreements that contain an accumulation of burdensome requirements, as such leases may be declared illegal and unenforceable under Kansas public policy. If a lease is found unenforceable under this provision, a tenant's obligation is generally reduced to paying only a fair and reasonable sum for use of the land, rather than the full terms of the voided agreement. Tenants who believe their lease may fall under this provision can consult a tenant-rights organization or a licensed Kansas attorney to understand the general enforcement paths available, including raising the provision as a defense in any dispute over lease obligations.
