Kan. Stat. Ann. § 58-2521
Repairs and improvements by cotenant.
Operative Text
If a joint tenant, or tenant in common, or tenant in coparcenary, have by consent management of the estate, and make repairs and improvements with the knowledge and without objection of his or her cotenant or coparcener, such cotenant or coparcener shall contribute ratably thereto.
Under Kansas law at Kan. Stat. Ann. §§ 58-2501–58-2521, when one co-owner of a property (whether a joint tenant, tenant in common, or coparcener) manages the shared estate with the agreement of the others and makes repairs or improvements while the other co-owners are aware and raise no objection, those other co-owners are required to share in the costs proportionally. The rule creates a cost-sharing obligation among co-owners based on their respective interests in the property. It applies specifically when the managing co-owner acts with consent and the others have knowledge of the work being done.
Plain English — not legal advice.
Property owners who share title with others and have been given management responsibilities under Kan. Stat. Ann. §§ 58-2501–58-2521 generally document the consent they have received to manage the estate and keep clear records of any repairs or improvements made. Compliant co-managing owners typically notify all co-owners of planned work in advance, giving them the opportunity to object or participate in decision-making. Maintaining written records of costs, notices, and the absence of objections helps establish the basis for seeking ratable contribution from co-owners.

Kan. Stat. Ann. §§ 58-2501–58-2521 establishes that co-owners who are aware of repairs or improvements being made to a shared property and do not object may be obligated to contribute their proportional share of those costs. If a co-owner believes they are being asked to contribute to costs for work they did not consent to or had no knowledge of, that lack of consent or knowledge may be relevant to whether the contribution obligation applies. Consulting a tenant-rights organization or an attorney familiar with Kansas property co-ownership law can help co-owners understand how this provision applies to their circumstances.
