Kan. Stat. Ann. § 58-2520
Occupant without special contract.
Operative Text
The occupant without special contract, of any lands, shall be liable for the rent to any person entitled thereto.
Under Kan. Stat. Ann. §§ 58-2501 through 58-2520, a person who occupies land without a formal written or special contract is still legally obligated to pay rent to whoever holds the right to receive it. The absence of a detailed lease does not eliminate the occupant's financial responsibility for use of the property. This rule establishes that occupancy itself, regardless of the formality of any agreement, creates a rent obligation under Kansas law.
Plain English — not legal advice.
Under Kan. Stat. Ann. §§ 58-2501 through 58-2520, property owners and managers generally recognize that even informal occupancy arrangements carry enforceable rent obligations. Compliant operators typically document the identity of any occupant and the basis for their occupancy, even when no formal lease is in place, to preserve their right to collect rent. Knowing that Kansas law supports a rent claim against occupants without special contracts can inform how landlords approach informal tenancy situations.

Kan. Stat. Ann. §§ 58-2501 through 58-2520 makes clear that occupying land without a formal contract does not shield a tenant from rent liability — the obligation to pay runs to whoever is legally entitled to receive it. Tenants in informal arrangements should be aware that the lack of a written lease does not necessarily limit the landlord's legal claim for rent. Those with questions about their rights or obligations in an informal occupancy situation may wish to consult a tenant-rights organization or legal aid service familiar with Kansas landlord-tenant law.
