Kan. Stat. Ann. § 58-25,101
Application of act, exclusions.
Operative Text
The provisions of this act shall not apply to an occupancy in or operation of public housing pursuant to any federal law or regulation with which it might conflict. This act shall govern the rental of mobile home space in mobile home parks. When both the mobile home and the space used to accommodate the mobile home are rented or leased by the same landlord, the residential landlord and tenant act, K.S.A. 58-2540 et seq., and amendments thereto, rather than this act, shall apply.
Kansas Statutes §§ 58-2501 through 58-25,101 establish the scope of the state's Mobile Home Parks Residents' Rights Act. The act governs the rental of mobile home spaces in mobile home parks, but it does not apply when its requirements would conflict with federal law or regulation governing public housing. A separate Kansas law—the Residential Landlord and Tenant Act (K.S.A. 58-2540 et seq.)—takes over when the same landlord rents both the mobile home unit and the land space beneath it.
Plain English — not legal advice.
Under §§ 58-2501 through 58-25,101, operators of mobile home parks generally comply with the Mobile Home Parks Residents' Rights Act when they rent only the land space to residents who own their own homes. Landlords who also own and rent out the mobile home itself should be aware that the Residential Landlord and Tenant Act (K.S.A. 58-2540 et seq.) governs that arrangement instead. Operators of public housing should review applicable federal law or regulation to determine whether this act's provisions are displaced.

Residents renting a mobile home space in a Kansas mobile home park are generally protected by the provisions of §§ 58-2501 through 58-25,101, the Mobile Home Parks Residents' Rights Act. However, if the same landlord rents both the home and the space, tenants' rights and remedies fall under the Residential Landlord and Tenant Act (K.S.A. 58-2540 et seq.) instead. Tenants who are uncertain which law applies to their situation may find guidance through a local tenant-rights organization or Kansas legal aid office.
