Under Kan. Stat. Ann. §§ 58-1401 through 58-1404, when public financial assistance is made available for dwellings in Kansas, program administrators are required to include information about the act's requirements in any related notices or educational materials. Before funds are released, recipients must sign an affidavit affirming their intent to comply with the act's requirements. A person who accepts such assistance and then fails to meet those requirements may lose eligibility for future public financial assistance, subject to the exceptions outlined in K.S.A. 58-1405.

For Property Managers

Property owners or managers who receive public financial assistance for dwellings under Kan. Stat. Ann. §§ 58-1401–58-1404 are generally expected to sign an affidavit of intent to comply with the act's requirements before funds are disbursed. Compliant operators typically familiarize themselves with the act's requirements at the time they receive program notices or educational materials, which administrators are required to provide. Failure to meet the act's requirements after accepting assistance can result in ineligibility for future public financial assistance programs, with limited exceptions under K.S.A. 58-1405.

For Tenants

Tenants living in dwellings supported by public financial assistance may have an interest in knowing that, under Kan. Stat. Ann. §§ 58-1401–58-1404, landlords who receive such assistance are required to sign an affidavit committing to comply with the act's requirements before funds are released. If a landlord fails to meet those requirements, the landlord may be barred from receiving future public financial assistance, which can be a relevant consideration when evaluating housing options. Tenants who believe a landlord has violated the act's requirements may wish to consult a tenant-rights organization or legal aid provider to understand what avenues may be available under Kansas law.
