Kan. Stat. Ann. § 58-1401
Accessibility standards for certain dwellings; definitions.
Operative Text
As used in this act: (a) “Dwelling” means any single family residence and each individual living unit in a duplex or triplex residential building which is constructed with public financial assistance. (b) “Public financial assistance” means: (1) A building contract or similar contractual agreement with any state agency; (2) any real estate received by the owner through a donation by the state; (3) state tax credits, except for tax credits pursuant to the Kansas housing investor tax credit act, K.S.A. 79-32,310 et seq., and amendments thereto; (4) grant assistance from state funds, except for grant assistance from the Kansas moderate income housing program, administered by the Kansas housing resources corporation with funding from the state housing trust fund pursuant to K.S.A. 12-5256, and amendments thereto, and appropriations acts; (5) state loan guarantees; or (6) federal funds administered by the state or a state agency. (c) “Director” means the director of the division of housing in the Kansas development finance authority.
Kansas Statute § 58-1401 establishes the foundational definitions for a state law governing accessibility standards in certain residential dwellings. Under this provision, the rules apply to single-family homes and individual units in duplexes or triplexes only when those properties are built using 'public financial assistance,' a term that covers a broad range of state and federal support—including state contracts, donated land, tax credits (with specific exclusions), grants (with specific exclusions), loan guarantees, and federally sourced funds administered by the state. The 'Director' referenced throughout the act refers to the director of the division of housing within the Kansas Development Finance Authority.
Plain English — not legal advice.
Property owners and developers subject to § 58-1401 should be aware that receiving certain forms of state or federal financial support—such as state tax credits, loan guarantees, or federally administered funds—can bring a residential project within the scope of Kansas's accessibility standards law. Notably, some funding sources are explicitly carved out, including credits under the Kansas Housing Investor Tax Credit Act and grants from the Kansas Moderate Income Housing Program, so operators generally review their specific funding sources against the definitions in § 58-1401 to determine whether the act applies. Compliance-oriented developers typically document the nature of any public financial assistance received at the time of construction.

For tenants living in single-family homes, duplexes, or triplexes, § 58-1401 is relevant because it defines which publicly assisted dwellings fall under Kansas's accessibility standards requirements. If a tenant believes their unit was constructed with qualifying public financial assistance—such as state loan guarantees or federal funds administered by a state agency—they may have grounds to explore whether the broader accessibility protections of the act apply to their home. Tenants seeking to understand whether their dwelling qualifies under § 58-1401 can consult a tenant-rights organization or reach out to the Kansas Development Finance Authority's division of housing for general information.
