Kan. Stat. Ann. § 44-1024
Same; effect of city ordinances governing housing practices.
Operative Text
Nothing in this act shall be construed to invalidate or limit any ordinance of any city in this state that grants, guarantees or protects the same rights as are granted by this act; but any ordinance of a city that purports to require or permit any action that would be a discriminatory housing practice under this act shall, to that extent, be invalid.
Kansas Statute §§ 44-1001 to 44-1024 establishes a relationship between state fair housing law and local city ordinances. A city ordinance that offers the same or stronger protections against discriminatory housing practices as the state act is permitted to stand. However, any city ordinance that would require or allow conduct that the state act defines as a discriminatory housing practice is rendered invalid to that extent by state law.

Under Kan. Stat. Ann. §§ 44-1001 to 44-1024, property owners and managers operating in Kansas cities should be aware that local ordinances may supplement state fair housing protections but cannot authorize conduct that the state act prohibits as discriminatory. A compliant operator generally reviews both state law and any applicable city ordinances to understand the full scope of fair housing obligations in their jurisdiction. Where a local rule appears to conflict with state anti-discrimination standards, the state act's requirements take precedence.

Kan. Stat. Ann. §§ 44-1001 to 44-1024 means that tenants in Kansas may benefit from city-level fair housing ordinances that go beyond state protections, as long as those local rules do not authorize discriminatory practices. If a tenant believes a local ordinance is being used to justify conduct that would be discriminatory under state law, that conflict may be raised as a legal issue, since such an ordinance would be invalid to that extent. Tenants seeking to understand how local and state fair housing rules interact can consult a tenant-rights organization or a local fair housing agency for general information.
