Kansas Statutes Annotated, Chapter 58, Article 54 (Removal of Squatters Act, §§ 58-5401 through 58-5407)
Removal of squatters act (K.S.A. 58-5401 through 58-5407, 7 sections), enacted by H.B. 2378, 2026 Kan. Sess. Laws ch. 56 (effective July 1, 2026). Establishes a procedure under which an owner or agent of a dwelling unit may cause the removal of a squatter (a person occupying a dwelling not entitled to be there under a lease or rental agreement and not authorized by a tenant; does not include a tenant holding over in periodic tenancy) by filing a notarized affidavit with law enforcement. Provides criminal penalties for knowingly filing a false affidavit; sets law-enforcement duties on receipt of the affidavit; establishes notice requirements at the dwelling; provides immunity provisions; and creates a civil cause of action for wrongful removal. Squatter occupancy is expressly excluded from the Residential Landlord and Tenant Act; removal does not require an eviction action under that act.
